▪ Abstract  This article strives to meet two challenges. As a review, it provides a critical discussion of the scholarship concerning undocumented migration, with a special emphasis on ethnographically informed works that foreground significant aspects of the everyday life of undocumented migrants. But another key concern here is to formulate more precisely the theoretical status of migrant "illegality" and deportability in order that further research related to undocumented migration may be conceptualized more rigorously. This review considers the study of migrant "illegality" as an epistemological, methodological, and political problem, in order to then formulate it as a theoretical problem. The article argues that it is insufficient to examine the "illegality" of undocumented migration only in terms of its consequences and that it is necessary also to produce historically informed accounts of the sociopolitical processes of "illegalization" themselves, which can be characterized as the legal production of migrant "illegality."

This article examines how migrant 'illegality' is experienced in the Swedish context. How do 'illegal' migrants manage work, housing, healthcare, safety and a family life in the absence of access to formal provisions? What are their survival strategies? I use direct quotations from undocumented migrants themselves to build a multifaceted picture of migrant 'illegality'. Following Willen's (2007) call for a 'critical phenomenology of illegality', I move beyond the socio-political situation of undocumented migrants to their embodied experiences of being 'illegal'. I conclude that undocumented migrants are not excluded but are excepted; they have not been thrown out, but neither are they considered participants. Undocumented migrants are included in society without being recognised as members.

Regularization, a means for people living with precarious immigration status to legalize or "regularize" their status, is a central demand of immigrant rights groups across Canada. From a perspective of No Borders, does the demand for regularization, while challenging the day-to-day practices of Citizenship and Immigration Canada, also unintentionally reinforce state power? Historical research on regularization programs in Canada suggests that regularization programs do not eliminate migrant illegality but reconfigure it. In this way, regularization may be implicated in processes that both makes and unmakes illegality within the context of immigration and citizenship in Canada. ; La régularisation, un moyen pour les personnes vivant avec un statut d'immigration précaire de légaliser ou de « régulariser » leur statut, est une revendication centrale de la défense des droits des immigrants partout au Canada. D'un point de vue No Border, la demande de régularisation, tout en contestant les pratiques usuelles de Citoyenneté et Immigration Canada, ne renforce-t-elle pas aussi involontairement le pouvoir étatique? La recherche historique sur les programmes de régularisation au Canada indique que ceux-ci ne suppriment pas l'illégalité des migrants; ils ne font qu'en modifier la configuration. Over the past decades, citizenship studies have explored in detail the various forms of social and civic integration achieved by otherwise illegal residents in contemporary immigration countries. While a great deal of analysis has tended to rest on a dichotomy between formal exclusion on the one hand and informal incorporation on the other, recent studies have begun questioning this dualistic model by examining the formal circuits of incorporation followed by unauthorized denizens at various geographical and institutional levels. Taking cues from this emerging line of research, this article makes three interconnected arguments. First, in contemporary liberal democracies, the rising tension between the illegal status of new immigrants and their limited but effective incorporation does not always pit formal law against informal practices, but is often located within law itself. Second, as a dynamic institutional nexus, "illegality" does not function as an absolute marker of illegitimacy, but rather as a handicap within a continuum of probationary citizenship. An incipient moral economy sees irregular migrants accumulating official and semiofficial proofs of presence, certificates of reliable conduct and other formal emblems of good citizenship, whether in the name of civic honor, in the hope of lesser deportability, or in view of future legalization. Third, such access to formal civic attributes is simultaneously being made increasingly difficult by the intensification of restrictions and controls from immigration, labor, and welfare authorities, thus confronting irregular migrants with the harsh dilemma of being framed as "more illegal" for the very documentary and economic features also assumed to improve their present and prospective civic deservingness. Here we advance the concept of legal–spatial consciousness—an individual's awareness of how law and space are mutually formed and influential on their lives. Through this concept, we explore how undocumented youth in a variety of American destinations understand and experience migrant illegality. By examining how immigration law and local places are imbricated, we demonstrate how immigrant illegality is defined not only by a patchwork of municipal, state, and federal laws, but also by how undocumented people move through these differently legal spaces in their everyday lives. Illegality is thus continually reproduced through individuals' im/mobility through space.

ABSTRACTIndia's militarization of its border with Bangladesh has grown alongside a paranoia around the figure of the "infiltrator" made synonymous with the "Bangladeshi illegal migrant." Set in the borderlands of India and Bangladesh, where ethnic, racial, and linguistic markers do not allow for an easy distinction to be made between the Bengali members of two nation‐states, this article focuses on the paradoxes of documentary citizenship. Residents of these highly surveilled borderlands, as well as a variety of state actors, find that simply possessing identity documents is inadequate amid forgery and deception. The possibility of detection—detectability—of the illegal migrant materializes in India's eastern borderlands across three distinct modes of policing: the interceptive, the judicial‐determinative, and the certificatory. Through an ethnographic exploration of these modes of policing, this article sheds light on the political economy of migrant illegality and reimagines detectability, the infinite and promissory search for the impostor within, as the engine that drives the state. This article explores how indigenous migrants experience the sociopolitical and existential condition of "illegality" in the United States. Drawing on the experiences of Maya migrants from Yucatán, Mexico, in the San Francisco Bay Area, I argue that the specter of state surveillance and the threat of law enforcement produce a particular politics of (im)mobility for indigenous migrants. This local politics of mobility takes form through spatial tactics of invisibility and visibility. Tracing migrants' tactical maneuvers through public space, I show how their relations to space, place, and movement alter cultural sensibilities of tranquilidad (tranquility),and further instantiate "illegality" as a site of exclusion. This analysis of the experiential effects of anticipated surveillance provides a deeper understanding of the power of the state to enforce migrant "illegality" even in cities that promise official sanctuary.
